1. Overview

This Cancellation and Refund Policy applies to all 3MotionAI subscriptions and services, including RiskAI, ROSA, HealthAI, and PerformAI, offered by SimpleTherapy, Inc. By subscribing to our Services, you agree to this policy. This policy is incorporated into and subject to our Terms and Conditions.

2. Subscription Plans

2.1 Subscription Terms

3MotionAI offers the following subscription options:

  • Monthly Subscriptions: Billed monthly on a recurring basis
  • Annual Subscriptions: Billed annually, paid upfront
  • Enterprise Agreements: Custom terms as specified in your Order Form or Quote

2.2 Auto-Renewal

All subscriptions automatically renew at the end of each subscription term at the then-current list price unless cancelled at least thirty (30) days prior to renewal. We will notify you via email before each renewal, including the renewal date and amount to be charged.

3. Trial and Pilot Periods

3.1 Trial Terms

Where offered, trial or pilot periods provide access for evaluation purposes only. Trial periods are provided “AS IS” without service level commitments. Your payment method will be charged at the end of the trial period unless you cancel before the trial expires.

3.2 Trial Cancellation

You may cancel at any time during your trial period without being charged. To avoid charges, you must cancel before the trial period ends. Cancellations received after the trial period ends will be treated as standard subscription cancellations (see Section 4).

4. Subscription Cancellation

4.1 Non-Renewal Notice

To prevent automatic renewal, you must provide written notice of non-renewal at least thirty (30) days prior to the end of your current subscription term. Enterprise customers should refer to their Order Form for specific notice requirements.

4.2 How to Cancel

You may cancel your subscription using one of the following methods:

  1. Email: Send a cancellation request to support@3motionai.com
  2. Support Portal: Submit a request through our support portal
  3. Account Manager: For enterprise customers, contact your designated account manager

4.3 Effect of Cancellation

When you cancel your subscription:

  • Your subscription will remain active until the end of your current subscription term
  • You will continue to have access to all features until your subscription expires
  • No further charges will be made after your current subscription term ends
  • Cancellation takes effect on your next renewal date, not immediately

4.4 Cancellation Confirmation

We will acknowledge your cancellation request within two (2) business days and provide written confirmation of your subscription end date. Our support hours are Monday through Friday, 9:00 AM to 5:00 PM Eastern Time, excluding holidays.

5. Refund Policy

5.1 General Policy

Subscription fees are non-refundable. If you cancel your subscription before the end of your subscription term, you will not receive a refund for any remaining period. We do not provide refunds or credits for partial subscription periods, unused features, or unused assessments.

5.2 Exceptions

We may consider refund requests on a case-by-case basis under the following circumstances:

  • Duplicate Charges: If you were charged multiple times for the same subscription period in error
  • Material Service Failure: If a significant, documented service issue prevented you from using the Services and we were unable to resolve it within a reasonable timeframe
  • Billing Errors: If you were charged an incorrect amount due to a system error
  • Unauthorized Charges: If charges were made without your authorization (subject to verification)

5.3 How to Request a Refund

To request a refund, please contact us at support@3motionai.com with your account email, the date and amount of the charge, and a detailed explanation of your refund request. Refund requests must be submitted within thirty (30) days of the charge. Approved refunds will be credited to your original payment method within 5-10 business days.

6. Data Retention After Cancellation

6.1 Data Retention Period

After your subscription ends, we will retain your account data (including videos, reports, and analytics) for thirty (30) days. Enterprise customers may have extended retention periods as specified in their Order Form.

6.2 Data Export

You may request an export of your data at any time by contacting support@3motionai.com. We recommend requesting data export before your subscription ends. We will use commercially reasonable efforts to provide your data in a standard format (such as JSON or CSV) within sixty (60) days of your request.

6.3 Data Deletion

After the retention period, your data may be permanently deleted in accordance with our Privacy Policy. If you require immediate deletion upon cancellation, please submit a written deletion request to support@3motionai.com.

7. Account Reactivation

If you cancelled your subscription and wish to return, please contact us at support@3motionai.com. If reactivated within the data retention period, your previous data may be restored. After the retention period, data may no longer be available.

8. Enterprise Agreements

Enterprise customers with executed Order Forms or Quotes may have different cancellation, renewal, and refund terms as specified in their agreement. In the event of a conflict between this policy and your Order Form, the Order Form shall control. Please refer to your specific agreement or contact your account manager for details.

9. Price Changes

Promotional or discounted pricing applies only to the initial subscription term. Upon renewal, subscriptions renew at the then-current list price. We will provide at least thirty (30) days’ notice of any price changes before your renewal date. If you do not agree with a price change, you may cancel before your next renewal.

10. Changes to This Policy

We may update this Cancellation and Refund Policy from time to time. Material changes will be communicated via email or through the Services with reasonable notice. The “Last Updated” date at the top of this policy indicates when it was last revised. Continued use of the Services after changes constitutes acceptance of the updated policy.
